  1. INTRODUCTION

Welcome to the AMAZOUL/AMAZOULFEST (Both names used indistinctly) event website. We appreciate your interest and trust in visiting our platform. As part of our commitment to transparency and respect for our users, we present our website usage policies that govern the interaction and use of our online services.

By accessing our website, users agree to submit to and comply with all provisions established in our usage policies. These policies are designed to ensure a safe, ethical, and legal environment for all visitors. By accepting these conditions, users acknowledge the importance of adhering to the established regulations, which cover aspects such as privacy, intellectual property, and other rights and responsibilities.

  1. IDENTIFICATION

The AMAZOUL/AMAZOULFEST  event website belongs to MoveWithUs SAS, identified with NIT XXXXXXXXX, Colombian company.

  1. DEFINITIONS

For the purposes of these terms and conditions, the following terminology shall be understood as described here:

  • E-contract: digital contract that functions automatically when making each order, celebrated between principal and agent, also celebrated between users and different commercial allies, both considered resolved upon completion of each order.
  • Electronic/digital commerce: understood as any commercial activity developed within the platform, such as, but not limited to the following: purchase of products, shipping, transmissions, professional management, or purchase and sale of any product or service that is exhibited within the platform.
  • User: A person who uses the website, who may or may not be subscribed to it, and will have limited use of some services, which MoveWithUs SAS will have full freedom to dispose of for this purpose.
  • Subscriber: a person who, in addition to making use of the website, enjoys a subscription and contractual agreement, which grants them additional uses, rights, and duties.
  • Market Place: digital platform that allows different businesses and/or sellers to exhibit and sell their products or services.

In addition, the following terms are defined:

  • Consumer: any person who uses the platform as the recipient of the order through the conclusion of a contract of sale or services with the businesses, products or services exhibited on the platform.
  • Electronic payment: online payment system that facilitates the acceptance of payments for online transactions over the Internet.
  • Payment gateway: service used by the operator to allow payments made by consumers through electronic platforms.
  • Platform: It is a digital system that facilitates interaction between users and providers of products or services through the internet. These platforms may vary in their functionality and purpose, but generally provide a virtual space where users can perform activities such as buying and selling goods, accessing information, communicating with other users or participating in other online services.
  • Commercial ally: any commercial establishment that offers its products or services through the platform for it to help as a means of exhibition and transport of the different products or services.
  • Operator: company in charge of carrying out the operation and maintenance of the platform. In this contract, it is specified that the company in charge is MoveWithUs SAS, although it is understood that it may transfer the operation to a third party, a fact that must be notified to consumers.
  1. THE SERVICE

The service provided by the AMAZOUL/AMAZOULFEST  event website allows interaction in different ways. Primarily, it allows users to purchase tickets for the AMAZOUL/AMAZOULFEST  event, which includes several days of music and cultural activities. The event includes accommodation, some meals, transportation, and attendance to the events.

The platform also functions as a place where artists and other content creators hosted on the platform can distribute original content, advertise, and promote it.

4.1 SERVICE UPDATE

In order to maintain the functionality and security of the service provided, the operator may perform periodic updates, which will not affect the terms and conditions, unless they introduce substantial changes in the way the service is provided. Within the service updates, there may be new functionalities, suppression of existing ones, offering of new digital content, among others, modifying the service provided or parts of it. These changes will be made to improve the service provided, its usability, security, or performance. Service updates may also be global or regional due to general legal compliance or by jurisdictions, as well as to prevent illegal activities from arising within our platform, or abuse to any of the users. These changes will not alter the terms and conditions, unless they affect the way the service is provided, or basic clauses of the same. In case of modification of the terms and conditions, these will be notified to users, either by email, or through the platform itself when logging in again.

  1. THE USER

The user of the platform, by accepting this agreement, expressly accepts that this subscription is an act of their own will, that there was no act of violence, harassment, threat, or any act by the platform or its collaborators for the acceptance of this. Likewise, they declare that they have the legal capacity to contract the obligations arising from this contract, that they have the legal age and consent to buy tickets or acquire services. Depending on the type of user, they will have different interactions within the platform, so there may be additional obligations arising from this same relationship.

5.1 USER RIGHTS

The user will have the right to use the services offered on the platform, but in turn, the USER will enjoy the following rights:

  1. a) Access to exclusive events: the event is only to ticket buyers, and special guests.

b).   1. c) Data protection: Users will have the right to the protection of their personal data in accordance with the platform’s privacy policies.
  2. d) Customer support: Users will have access to specialized and priority customer support to resolve any problems or doubts they may have.

5.2 USER OBLIGATIONS

The user’s obligations are to respect the following basic guidelines:

  1. Provide truthful, current, and complete information during registration and in any interactions with the platform.
  2. Use the website solely for legal purposes and in connection with the promotion and purchase of tickets for the AMAZOUL/AMAZOULFEST

  5. Assume full responsibility for any activities conducted through their account, including ticket purchases and attendance at the event.
  6. Comply with all applicable laws and regulations during their participation in the AMAZOUL/AMAZOULFEST event, as well as in their use of the platform.
  7. Acknowledge that MoveWithUs SAS is not responsible for inappropriate or illegal behaviors of users during the event.
  8. In turn, the user is reminded that by means of this they give authorization for the use of personal data, through the data treatment authorization contract.
  9. THE OPERATOR

MoveWithUs SAS, identified with NIT XXXXXXXXX, located in Medellin – Colombia, operator of the AMAZOUL/AMAZOULFEST  event website.

6.1 OPERATOR OBLIGATIONS

The operator’s obligations for this agreement are as follows:

  1. a) Data protection: an operator of the platform/website, must protect users’ personal data and comply with applicable data protection laws.
  2. b) Copyright: the platform operator must ensure that all content hosted on the platform complies with copyright and intellectual property laws. It must have a system to respond to copyright infringement claims and remove infringing content.
  3. c) Quality of service: the platform operator must guarantee the quality of the service it provides, including the stability of the platform and the availability of content.
  4. d) Consumer protection: the platform must comply with consumer protection laws and offer protection measures against fraud or abuse.
  5. e) User protection: ensure the protection of copyright holders in accordance with the mandate carried out.
  6. f) Transparency: the platform operator must provide clear and accurate information about the terms and conditions of use, the treatment of personal data, and prices and rates.
  7. g) Prevention of illegal activities: the platform must implement measures to prevent illegal activities on its website, including the sale of illicit products, the dissemination of violent or discriminatory content, or harassment of other users.
  8. h) Payments and billing: the platform operator must ensure that payments made through its site are secure and protected. It must also provide clear and accurate invoices.

In summary, a platform operator has the responsibility to ensure the quality of service, protect personal data and copyrights, offer consumer protection measures, be transparent in its policies and prices, prevent illegal activities and ensure payments and billing.

  1. PAYMENTS ON THE PLATFORM

7.1 PURCHASES

  1. a) To request a purchase of tickets for the AMAZOUL/AMAZOULFEST event or make a purchase in relation to the Services, you must meet the following conditions: (a) be at least 18 years old, (b) declare that the money or money alike currency use for the purchase, is not used to committed fraud, or any illegal activity.
  2. b) MoveWithUs SAS may contract an external service provider to provide you with the Services through a package along with other services provided by said external provider. The payment terms for such service and other terms and conditions governing its use may vary from the terms set forth in this Agreement. You are responsible for reviewing the terms and conditions and/or any other terms governing the use of the services provided.
  3. c) Providers or third parties we contract to provide the Services may offer special promotions or trials with different conditions and limitations that may be subject to terms other than these Terms. The user is responsible for reviewing any additional terms governing the use of such promotions or special trials before accessing a promotion or special trial.
  4. d) In relation to any service/product you choose to purchase, you must provide MoveWithUs SAS with a current, valid and permitted payment method. All purchases of products or services hosted on or by the platform are subject to this Agreement and any additional terms and conditions, including charges, imposed by your financial service provider or mobile service provider, as applicable.
  5. e) MoveWithUs SAS reserves the right to modify, suspend or discontinue the Services at any time, with or without prior notice.
  6. f) The Service Content is protected by intellectual property, both copyright and industrial property, or other concordant laws, and may not be reproduced, distributed, transmitted, displayed, sold, licensed or otherwise exploited without the prior written consent of the copyright holder or trademark owner.

These are some of the additional conditions that should be taken into account when using the paid service of the “AMAZOUL/AMAZOULFEST ” platform. It is important to carefully read all conditions before subscribing or making a purchase in relation to the Services.

7.2 CANCELLATIONS

General cancellation conditions for the associated user:

To cancel your account and end your relationship with MoveWithUs SAS, the user must fill out the cancellation form, which will be available on the platform. This process guarantees a safe and personalized transition, allowing to resolve any concerns and ensuring the correct termination of the contracted services.

Procedure:

  1. The user interested in canceling their account must enter the platform, where they will find the “cancel reservation/cancel ticket” item, which will take them to a form that must be filled out completely, indicating their full name, associated email and reason for cancellation.
  2. An email will be sent to the email registered on the platform with one of the following communications: successful cancellation of the subscription and/or pending cancellation of the subscription due to existence of outstanding balances.
  3. In case these outstanding balances exist, the cancellation will be suspended until these outstanding balances are not paid to the Platform/web.

Important Considerations:

  • MoveWithUs SAS reserves the right to request additional information to verify the user’s identity before proceeding with the cancellation.
  • Any outstanding balance or contractual commitments must be resolved before the effective termination of the account (clearance certificate).
  1. PROHIBITED CONDUCT

The following conducts are prohibited by any user of the platform/website, regardless of the quality with which they make use of it.

  1. Create a false identity or use third-party accounts.
  2. Use malicious software to enter the application, or other means to take advantage of the service.
  3. Reverse engineer the application’s operating processes to copy the services.
  4. Circumvent security measures or functionality used as access control.
  5. Disclose or distribute any information about the services.
  6. Infringe intellectual property belonging to MoveWithUs SAS or the intellectual property rights of others.
  7. Copy or distribute the content of the application.
  8. Market, rent, lend, or obtain economic benefits on the AMAZOUL/AMAZOULFEST application.
  9. Interfere with the operation of the services by infringing the security system, these types of conduct are enshrined in the Colombian penal code article 269.
  10. Any act, form or pretension to harm the AMAZOUL/AMAZOULFEST platform.
  11. Any illicit purpose.
  12. Request others to perform or participate in any illegal act.
  13. Infringe any national and international regulations, rules, laws.
  14. Harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability.
  15. Submit false or misleading information.
  16. Upload or transmit viruses or any other type of malicious code that affects or may affect in any way the functionality or operation of the application and/or Services, third-party products and services or the Internet.
  17. Serve as spam, phishing, pharm, pretext, spider, crawl, or scrape.
  18. Any obscene or immoral purpose.
  19. Interfere with or circumvent the security features of the Mobile Application and Services, third-party products and services, or the Internet. MoveWithUs SAS reserves the right to terminate the use of the Mobile Application and Services for violating any of the prohibited uses.
  20. THIRD-PARTY SERVICES

Within the platform/website, third-party services will be provided.

If the USER decides to enable, access or use third-party services, they should be aware that their access and use of those other services are governed exclusively by the terms and conditions of those other services, and that MoveWithUs SAS does not endorse these, is not responsible for them, and makes no warranty as to any aspect of those other services, including, without limitation, their content or the manner in which they handle data (including your data) or any interaction between the USER and the provider of those other services. The USER irrevocably waives any claim against MoveWithUs SAS with respect to those other services. MoveWithUs SAS is not responsible for any damage or loss caused or allegedly caused by or in connection with your enabling, access or use of any of those other services, or your reliance on the privacy practices, data security processes or other policies of those other services.

You may need to register or log in to those other services on their respective applications. By enabling any other service, the USER expressly authorizes MoveWithUs SAS to disclose their data when necessary to facilitate the use or enabling of that other service.

  1. INDEMNITY AND LIMITATION OF LIABILITY
  2. a) Responsible users: Users of the AMAZOUL/AMAZOULFEST platform will be responsible for any content they publish or share on the platform and will guarantee that said content does not infringe the rights of third parties or violate any applicable law or regulation.
  3. b) Release of liability: The AMAZOUL/AMAZOULFEST platform and its owners, directors, employees, agents and affiliates will not be responsible for any claim, damage, loss or expense that arises as a result of the use of the platform or the content published by users.
  4. c) Indemnification: Users of the platform will indemnify and hold harmless the AMAZOUL/AMAZOULFEST platform and its owners, directors, employees, agents and affiliates from any claim, damage, loss or expense, including reasonable attorneys’ fees, that arise as a result of the use of the platform or the content published by users.
  5. d) Cooperation: Users of the platform will fully cooperate with the AMAZOUL/AMAZOULFEST platform and its owners, administrators, employees, agents and affiliates in the defense of any claim or legal action.
  6. e) Notification: Users of the platform will immediately notify the AMAZOUL/AMAZOULFEST platform in case of any claim or demand related to the use of the platform or the content published by users.
